US Airways filed a new lawsuit in the US District Court in Arizona seeking a Declaratory Judgement from the court concerning the arbitrated seniority list
The suit asks the court provide one of three rulings: the Nicolau list is the final and binding seniority list, or; the company is free to engage USAPA in negotiation of a new seniority list, or; the company is absolved of any future liability from west pilots if USAPA proposes and passes a new seniority list as part of current NMB negotiations
The 9th Circuit Court overruled lower court's judgment against USAPA in May
The Court remanded the case and determined that it is not ripe for adjudication
USAPA was found guilty of DFR by a District Court jury; the 9th ruled the case was not ripe and did not address any of the other issues that USAPA appealed
